Monday - February 19, 2018

1. George Burch
1st Degree Intentional Homicide (F)

Case 16CF1309 - 12 Person Jury Trial Begins
  • Arrest date September 7, 2016
    • September 2016: Order to seal probable cause statement. Probable cause hearing, $2,000,000 cash bond set. Complaint Filed & Initial Appearance.
    • October 2016 - Preliminary Hearing. Defendant bound over for trial. Present bond continued. Exhibit #1 - Criminal Complaint accepted by the court.
    • April 2017 - Defense motions & submits brief in support to introduce evidence @ trial that Douglass Detrie committed the murder of Nicole Vanderheyden.
    • May 2017 - Defense submits brief to admit Denny evidence Defense replies to state's response on motion to introduce evidence that Detrie committed this murder.
    • June 2017 - Letter received by court written to police department from Google - letter dated June 7.
    • August 2017 - Motion to admit other acts into evidence.
    • September 2017 - Stipulation & order regarding use of phone materials as evidence.
    • October 2017 - State motions court to seal records.
    • November 2017 - Defense submits motion opposing state's request to seal court records. Notice of intent to introduce DNA evidence.
    • December 2017 - Defense's motion to exclude all FitBit related evidence.
    • January 2018 - Defense motions to suppress evidence from Burch's cell phone. State responds to motion to suppress evidence stating Burch gave consent to phone information after a hit & run accident. Consent did not exclude any use of cell phone information.
    • February 2018 - Substantive jury instructions. Defendant's request for jury instructions. Jury selected of 8 men and 6 women (2 substitute jurors). Defense's brief in support of requested jury instructions on the burden of proof. State & Defense present witness lists to court. Jury sign-in sheet and seating chart completed.

      • August 2017 - Hearing on no contact order. No appearance by defendant. Victim in court & requested no contact order to be lifted. Court modifies no contact order: At victim's discretion, may have telephone contact & face to face contact in a public setting only. Court finds probable cause and defendant is bound over for trial.
